Introduction

These Terms of Service ("Terms") govern your use of NIL Sports Tech, a web-based platform for elite athletes to create and manage personalized applications. By creating an account or using NIL Sports Tech, you agree to these Terms. If you do not agree, do not use the platform.

1. Service Description

NIL Sports Tech is a web-based platform that enables athletes to create and manage personalized applications with AI and e-commerce features. By using our platform, you agree to comply with these Terms of Service.

2. Account and Authentication

2.1 Account Creation

You must choose a unique ticker/username
You must create a secure PIN for authentication
You are responsible for keeping your PIN confidential
You must be at least 13 years old (16 in the EU) to use NIL Sports Tech
If you're under 18, you must have parental consent

2.2 Account Security

You are responsible for all activity on your account
If your PIN is compromised, contact us immediately
We are not liable for unauthorized access due to PIN sharing

3. User Content and Ownership

You own all content you create on NIL Sports Tech
By uploading content, you confirm you have the rights to share it
You grant NIL Sports Tech a license to host and display your content
You are responsible for ensuring your content complies with all laws

4. Payment and Fees

NIL Sports Tech supports the following payment methods:

Square: Credit/debit cards, Apple Pay, Google Pay (fees apply)

4.1 Payment Processing Fees

Square charges 2.9% + $0.30 per transaction
These fees are charged by the payment processors, NOT by NIL Sports Tech
These fees are non-refundable, even if a refund is issued

4.2 Service Fees

Transaction Fees: NIL Sports Tech does NOT take a cut of your sales

4.3 Refund Policy

All sales are final. NIL Sports Tech does NOT provide refunds for any services, features, or transactions, including but not limited to:

Shop Purchases: Refund policy is set by the individual app owner (not NIL Sports Tech)

4.4 Dispute Resolution

Payment Issues: Contact Square support for payment problems

5. Intellectual Property

5.1 Your Content

You retain all rights to content you create
You grant NIL Sports Tech a license to host and display your content
You are responsible for obtaining rights to any third-party content you use

5.2 NIL Sports Tech Intellectual Property

NIL Sports Tech name, logo, and platform design are our property
You may not use our branding without written permission
You may not reverse engineer or copy our platform

6. Prohibited Conduct

You may NOT use NIL Sports Tech for:

Illegal activities or content
Harassment, hate speech, or discrimination
Scams, fraud, or phishing
Impersonation or identity theft
Spamming or mass unsolicited messaging
Violating others' intellectual property rights
Hacking, exploiting bugs, or circumventing security measures
Money laundering or terrorist financing

7. Third-Party Services

NIL Sports Tech integrates with third-party services (Anthropic, Meshy, OpenAI, Square). These services have their own terms of service:

By using these features, you agree to comply with the respective third-party terms.

8. Disclaimer of Warranties

NIL Sports Tech is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy of information
Uninterrupted or error-free service

9. Limitation of Liability

To the maximum extent permitted by law, NIL Sports Tech shall NOT be liable for:

Loss of profits, revenue, or data
Loss of funds due to user error (e.g., lost PIN)
Third-party payment processor issues
Unauthorized access to your account

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination:

Your access to NIL Sports Tech will be revoked
Content may be removed from our servers

11. Changes to Terms

We may update these Terms at any time. Continued use of NIL Sports Tech after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or in-app notification.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the United States.
